VoteMySite.com Terms of Service
1. Agreement and acceptance
These Terms of Service (the "Terms") form an agreement between you and Dot Coms, Inc., the owner and operator of VoteMySite.com (collectively, "VoteMySite.com," "VoteMySite," "we," "us," or "our"). They apply to the VoteMySite.com site, Control Panel, site listings, rankings, categories, voting and rating functions, voting buttons, sliders, popups, tracking images, scripts, banner-upload tools, statistics, reviews, search functions, email notices, and all related services we make available.
You accept these Terms when you visit the site, create or use an account, submit or edit a site, install any VoteMySite code, cast a vote, click a listed site, upload a banner, use statistics, or otherwise interact with the service. Your continued use after an update means you accept the revised Terms.
2. Operator, ownership, and support
VoteMySite.com is owned and operated by Dot Coms, Inc. Dot Coms, Inc. controls the platform, its branding, software configuration, rankings, moderation standards, account administration, and service rules. Questions, account assistance, abuse reports, legal requests, and support inquiries must be submitted through Client Assistance.
Client Assistance receives requests on behalf of VoteMySite.com and Dot Coms, Inc. It does not guarantee that every request will result in restoration, removal, ranking adjustment, reimbursement, or any particular outcome.
3. Eligibility and legal capacity
You must be legally capable of accepting these Terms. Children under 13 may not create accounts, submit sites, upload banners, or provide personal information through the service. A person who has not reached the age of legal majority in their jurisdiction may use account-management features only with the consent and supervision of a parent or legal guardian who accepts responsibility for the account and submitted sites.
If you use VoteMySite.com for a company, organization, client, or other legal entity, you represent that you have authority to bind that entity and manage the submitted site. You may not create an account or submit a site on behalf of another person or entity without authorization.
4. What the service provides
VoteMySite.com allows site owners to create public listings and allows visitors to discover, compare, visit, vote for, and interact with listed sites. Features may include:
- site submissions containing a URL, title, description, category, banner, and related information;
- public rankings based on pageviews, votes or incoming activity, outgoing visits, or other enabled methods;
- voting codes, static buttons, simple links, invisible tracking images, sliders, popups, and on-load or exit-triggered voting prompts;
- unique and total pageview, vote, incoming, and outgoing activity statistics;
- account tools for managing multiple sites, editing listings, uploading banners, and viewing statistics;
- reviews, ratings, search, category browsing, featured listings, and other promotional or discovery features.
The service is a directory, ranking, voting, and measurement platform. It is not an endorsement, certification, security audit, consumer guarantee, or verification of any listed site, product, service, statement, owner, or offer.
5. Account registration and security
You must provide accurate, current, and complete information. You are responsible for your username, password, email address, two-factor authentication settings, recovery access, and every action performed through your account. You must promptly update information that becomes inaccurate and notify Client Assistance if you suspect unauthorized access.
You may not sell, rent, transfer, share, or commercially trade an account without written authorization from Dot Coms, Inc. You may not impersonate another person, create deceptive identities, register usernames intended to mislead users, or use another person's email address without permission.
Usernames and internal site identifiers may be permanent because they can be connected to voting codes, statistics, database records, and public URLs. VoteMySite.com is not required to change a username or identifier after registration.
6. Site submissions and owner responsibilities
You may submit only a site that you own, operate, or are expressly authorized to represent. By submitting a site, you represent and warrant that:
- the URL is valid and leads to the site described in the listing;
- the title, description, category, and banner are accurate and not misleading;
- the site and listing do not violate law, third-party rights, these Terms, or the rights of users;
- you have all rights and permissions needed to submit the site, display its name and banner, and install VoteMySite code;
- you will keep the listing current and remove or update information that becomes false, outdated, or unauthorized.
You remain solely responsible for your site, including its content, privacy notices, security, products, services, transactions, users, legal compliance, and any consequences arising from visits referred through VoteMySite.com.
7. Absolute prohibition on adult sites and adult content
Content involving sexual exploitation, child sexual abuse material, sexual content involving minors, trafficking, coercion, or non-consensual material is strictly prohibited and may be reported to appropriate authorities. Attempting to disguise, temporarily remove, cloak, redirect, or conceal adult content during review is a material violation.
Dot Coms, Inc. may reject or remove a site when its adult nature is apparent, reasonably suspected, discovered after approval, or produced through redirects or later content changes. Removal may occur without advance notice and without restoration of rankings, votes, traffic records, banners, or account access.
8. Other prohibited sites and content
You may not submit, promote, or link to sites or content that involve:
- malware, spyware, ransomware, deceptive downloads, phishing, credential theft, or malicious code;
- fraud, scams, impersonation, counterfeit goods, pyramid schemes, or deceptive financial practices;
- illegal products, controlled substances, unlawful weapons, trafficking, or instructions intended to facilitate crime;
- hate, credible threats, harassment, stalking, doxxing, incitement to violence, or unlawful discrimination;
- copyright, trademark, privacy, publicity, database, or other intellectual-property infringement;
- false claims, misleading redirects, hidden destinations, automatically initiated downloads, or material misrepresentation;
- content that interferes with VoteMySite.com, overloads the service, compromises security, or harms users.
Dot Coms, Inc. may determine whether content is acceptable based on the context, destination, presentation, safety risk, legal risk, and overall purpose of the site.
9. Voting integrity, rankings, and prohibited manipulation
Votes, pageviews, incoming activity, outgoing activity, ratings, and rankings must result from legitimate user activity. You may not manipulate the service through bots, automated browsers, scripts, click farms, traffic exchanges designed to fabricate activity, paid voting, forced clicks, hidden frames, invisible overlays, misleading prompts, proxy rotation, VPN abuse, repeated self-voting, cookie clearing, IP manipulation, or coordinated fraudulent activity.
You may invite real visitors to vote and may place an approved VoteMySite code on a site you control. You may not falsely represent that a vote is required to access content, deceive users about what will occur, or use the code in a manner that generates activity without a genuine user interaction when interaction is expected.
VoteMySite.com may use IP addresses, timestamps, session information, traffic patterns, and other signals to identify duplicate, suspicious, invalid, or abusive activity. We may disregard, reverse, recalculate, limit, or remove votes and statistics; change ranking methodology; quarantine traffic; suspend codes; or remove listings. We are not required to disclose anti-abuse rules, thresholds, detection methods, or evidence that could enable circumvention.
10. Voting codes, scripts, widgets, and tracking
Each site may receive a unique voting or tracking identifier. Codes may send requests to VoteMySite.com when a page loads, a visitor clicks, a widget opens, or another described event occurs. This information may be used to calculate traffic, votes, rankings, fraud controls, and statistics.
You may install a code only on a site you own or are authorized to modify. You are responsible for:
- placing the correct code on the correct site;
- not altering the code to misrepresent activity or bypass protections;
- providing privacy and cookie disclosures required for your site and jurisdiction;
- obtaining any consent required before loading non-essential technologies;
- removing the code if your listing is deleted, authorization ends, or you stop using the service.
Code availability, format, appearance, animation, timing, position, compatibility, and behavior may change. VoteMySite.com does not guarantee that every code will function with every browser, content-management system, security policy, ad blocker, cache, script optimizer, or site configuration.
11. Banners, reviews, ratings, and submitted content
You retain ownership of content you submit, subject to the rights you grant here. By submitting a title, description, banner, review, rating, category selection, site name, logo, screenshot, or other material, you grant Dot Coms, Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, display, distribute, cache, format, and use that material as reasonably necessary to operate, promote, secure, and improve VoteMySite.com.
You confirm that submitted material does not infringe third-party rights. We may crop, resize, reject, remove, disable, or replace content that is broken, misleading, unsafe, low quality, incompatible, prohibited, or legally disputed. We do not guarantee continued display of a banner, review, rating, screenshot, or listing.
12. Public listings and visibility
Site titles, descriptions, URLs, categories, banners, rankings, votes, pageview totals, outgoing totals, join dates, reviews, and other listing information may be public and indexed by search engines. Do not submit confidential, private, regulated, or personally sensitive information for public display.
Removing a listing from VoteMySite.com does not guarantee immediate removal from search-engine caches, archives, third-party indexes, screenshots, backups, or copies outside our control.
13. Third-party sites and external transactions
VoteMySite.com contains links to sites operated by third parties. We do not control and are not responsible for their content, security, privacy practices, availability, advertising, products, services, claims, transactions, or conduct. A ranking, listing, category placement, banner, vote count, or featured position does not constitute endorsement.
You visit listed sites at your own risk. Any purchase, subscription, registration, communication, download, contract, dispute, or loss involving a listed site is solely between you and that site's operator.
14. Communications
We may send administrative, security, account, password-reset, two-factor authentication, moderation, legal, service, or site-status communications. Account holders may be able to opt out of non-essential news or promotional messages, but cannot opt out of communications necessary to operate, secure, or administer an account or comply with law.
15. Moderation, suspension, and termination
Dot Coms, Inc. may review, approve, reject, deactivate, edit, reclassify, restrict, suspend, or permanently remove a site, account, code, banner, review, vote, statistic, or other content when we believe it violates these Terms, presents risk, is inactive, is misleading, causes technical problems, receives valid complaints, or is inconsistent with the service.
Enforcement may occur with or without prior notice. We are not obligated to provide an appeal, preserve data, restore rankings, transfer votes, maintain a listing, or explain confidential security and anti-abuse decisions. You may stop using the service at any time and may request account or listing assistance through Client Assistance.
16. Service availability and changes
The service is provided on an "as available" basis. Features may be added, changed, limited, suspended, or discontinued. Rankings, methods, categories, traffic calculations, code formats, display positions, limits, and eligibility rules may change. Maintenance, hosting issues, security events, software defects, third-party failures, and circumstances beyond our control may interrupt access.
We do not guarantee uninterrupted service, permanent data retention, specific ranking positions, search-engine results, traffic increases, votes, referrals, revenue, popularity, site approval, or any business outcome.
17. Intellectual property
VoteMySite.com, its branding, design, interface, original content, code, databases, graphics, voting systems, ranking presentation, and related materials are owned by Dot Coms, Inc. or used under applicable licenses. Except for the limited right to use approved voting codes as intended, you may not copy, resell, reverse engineer, reproduce, create derivative services from, or exploit the platform without written authorization.
You may use VoteMySite-provided buttons and code only to link to or interact with VoteMySite.com in accordance with these Terms. You may not imply sponsorship, certification, partnership, ownership, or endorsement that does not exist.
18. Disclaimers
To the fullest extent permitted by law, VoteMySite.com and all features are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. Dot Coms, Inc. disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, availability, compatibility, and results.
We do not warrant that listed sites are legitimate, safe, accurate, lawful, free from malware, suitable for any person, or operated by the person who submitted them. Users must make their own decisions and take appropriate security precautions.
19. Limitation of liability
To the fullest extent permitted by applicable law, Dot Coms, Inc., VoteMySite.com, Client Assistance, administrators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages; loss of data, traffic, rankings, reputation, business, revenue, opportunities, or goodwill; unauthorized access; service interruption; third-party conduct; or reliance on listings, statistics, rankings, votes, or links.
Where liability cannot be excluded, liability will be limited to the minimum amount permitted by law. Nothing in these Terms excludes rights or liabilities that cannot legally be waived.
20. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Dot Coms, Inc., VoteMySite.com, Client Assistance, and their personnel from claims, losses, liabilities, damages, judgments, costs, and reasonable expenses arising from your site, submitted content, code installation, account activity, violation of these Terms, violation of law, infringement of rights, or dispute with a visitor or third party.
21. Legal compliance and cooperation
You must comply with laws applicable to your activity, site, content, marketing, privacy practices, and use of tracking technologies. Dot Coms, Inc. may preserve and disclose information when reasonably necessary to comply with valid legal process, enforce these Terms, protect users, investigate abuse, prevent fraud, respond to emergencies, or defend legal rights.
22. Governing principles and disputes
These Terms are governed by applicable United States law and, where relevant, the law applicable to Dot Coms, Inc. at its principal place of business, without overriding mandatory consumer rights that apply in a user's jurisdiction. Before filing a formal claim, you agree to submit a detailed written description through Client Assistance and allow a reasonable opportunity to investigate and respond.
No provision requires a user to waive a right that cannot legally be waived. Venue, procedure, limitation periods, and remedies remain subject to applicable law.
23. Changes to these Terms
Dot Coms, Inc. may revise these Terms to reflect service changes, security needs, legal requirements, enforcement practices, or operational decisions. Updated Terms become effective when posted unless a later date is stated or applicable law requires additional notice. You are responsible for reviewing the current version.
24. Severability, waiver, and entire agreement
If any provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Cookie Policy, constitute the agreement governing use of VoteMySite.com.
